Warranty and Statutory Liability for Defects

This page informs you about your statutory rights in case of defects and about the difference between statutory liability for defects and a voluntary warranty.

Statutory Liability for Defects

All orders in our online shop are subject to the statutory liability for defects under German law.

Statutory liability for defects means: If a product was already defective upon delivery, you, as the customer, are entitled to the legally stipulated rights. These include, in particular, subsequent performance, i.e., repair or replacement. If subsequent performance is not possible or fails, further statutory rights may exist, for example, a reduction in the purchase price or withdrawal from the contract.

Statutory liability for defects applies regardless of whether a voluntary warranty also exists.

Duration of Statutory Liability for Defects

For new goods, the statutory limitation period for defect claims is generally two years from the delivery of the goods.

If a defect appears in a consumer goods purchase within one year of delivery, it is legally presumed that this defect was already present at the time of delivery of the goods, unless this presumption is incompatible with the nature of the goods or the defect.

After this period, the customer may need to prove that the defect existed at the time of delivery.

What constitutes a defect?

A defect exists, in particular, if the product, upon delivery, does not have the agreed quality, is not suitable for the usual use, or does not meet the usual expectations for a product of its kind.

Generally, no defect exists in cases of:

  • normal wear and tear,
  • damage due to improper use,
  • damage due to incorrect assembly or care,
  • damage due to external influences,
  • natural changes in the surface that may occur due to material or weather conditions.

For products with a natural rust or patina surface, slight deviations in color, structure, and surface are typical for the material. They do not constitute a defect, provided that the function and the agreed quality of the product are not impaired.

Voluntary Warranty

A warranty is a voluntary additional service provided by the manufacturer or seller. It only exists if it has been expressly stated for a specific product.

The customer's statutory rights in case of defects are not restricted by a voluntary warranty. Consumers can claim their statutory rights for defects free of charge.

If a voluntary manufacturer's warranty is offered for a product, the warranty conditions stated for the product or in the warranty declaration apply. These include, in particular, information about the warrantor, the duration, the geographical scope, and the procedure for making a claim.

How to report a defect

If you wish to report a defect, please contact us as soon as possible after discovering the problem.

Please send us the following information:

  • Your order number,
  • Your name and contact details,
  • a brief description of the defect,
  • photos of the product and the affected area,
  • if available: photos of the packaging in case of transport damage.

Transport Damage

Please check the delivery upon receipt. If the goods have been obviously damaged during transport, please document the damage with photos of the packaging and the product and contact us promptly.

Your statutory rights in case of defects remain unaffected by this.
